terms of service

1. This agreement applies between the artist (hereinafter referred to as the Seller) and the person or organization purchasing a commission (hereinafter referred to as the Customer). By commissioning the Seller, the Customer agrees to the following Terms of Service.2. Before starting the artwork, the Seller will provide a rough sketch to confirm the commission idea.3. Once the sketch has been approved, the Customer must pay 50% of the total commission price (or another mutually agreed percentage).4. Work on the final artwork will not begin until the initial payment has been received.5. The remaining 50% must be paid once the artwork is completed. The final high-resolution file will only be delivered after full payment has been received.6. Payments are accepted in USD. Customers located in Chile may also pay via BancoEstado.7. Any alternative payment method or payment plan must be agreed upon before the commission begins.8. All commissions are delivered digitally.9. The final artwork will only be sent after full payment has been received.10. The estimated turnaround time is 3 business days to 1 week, depending on the complexity of the commission and the Seller's availability.11. The commission only includes the creation and delivery of the final artwork. Process videos (speedpaints), source files (PSD, Clip Studio, Procreate, etc.), and other working files are not included unless previously agreed.12. Once the artwork has been delivered, it is the Customer's responsibility to store and back up the files. The Seller is not responsible for lost files and cannot guarantee that backup copies will be available indefinitely.13. The Customer is entitled to 3 major revisions during the sketch stage.14. Once rendering has begun, only minor changes, such as color adjustments or small details, will be accepted. Major revisions may require an additional fee.15. If the Customer requests significant changes to the pose, composition, character, or overall concept after approving the sketch, the request may be treated as a new commission or require an additional charge.16. All artwork is created in the Seller's personal artistic style. While the provided references will be followed as closely as possible, the final result will not be an exact 100% copy.17. The Seller reserves the right to make minor artistic adjustments to improve the overall quality of the final artwork.18. The Customer may request a refund only if the commission has not been started within 3 business days, or if it has not been completed within 1 week, unless the Seller has previously informed the Customer of a justified delay.19. If substantial progress has already been made, the refund may be partial or unavailable depending on the amount of work completed.20. If the Customer cancels the commission after work has begun, the initial payment is non-refundable.21. The Customer is responsible for providing clear references and responding to the Seller's questions in a timely manner.22. If the Customer becomes unresponsive for 15 days, the commission may be placed on hold. If no response is received within 30 days, the commission may be considered cancelled without refund for the work already completed.23. Unless otherwise agreed, all commissions are for personal use only.24. Reselling, reproducing, redistributing, modifying for commercial purposes, or otherwise profiting from the artwork is prohibited without the Seller's written permission and the purchase of commercial rights.25. The Customer may not claim ownership or authorship of the artwork.26. The Customer may not use the artwork for NFTs, cryptocurrency, blockchain-related projects, or similar technologies.27. The Customer may not use the artwork for AI training, datasets, image generation, machine learning, or any present or future AI-related technologies.28. The Seller retains all copyrights to the commissioned artwork and reserves the right to display it in their portfolio and on social media unless confidentiality has been agreed upon beforehand.29. The Seller reserves the right to refuse or cancel any commission for justified reasons.30. Any disrespectful, abusive, discriminatory behavior or attempted fraud may result in the immediate cancellation of the commission. Refunds will be issued in full or in part depending on the amount of work completed, and the Seller reserves the right to refuse future commissions from the Customer.31. By commissioning the Seller, the Customer confirms that they have read, understood, and agreed to these Terms of Service.
